APPLICATION
FOR SPECIAL LEAVE TO APPEAL
1. The
applicant applies for special leave to appeal the whole of the judgment of the
master of the Supreme Court of South Australia on 8 August 2014.
GROUNDS
1. The
master erred by not providing lawful and proper reasons for the refusal of the
documents. It appears that the Registrar
has made some comments and the master has made some comments but a final
judgment has not actually been written or reasons provided.
2. The
master erred by assuming and thinking that these matters were to re-litigate’ a
matter when in fact that there is no re-litigation whatsoever and these matters
are still alive and well before the courts.
ORDERS
SOUGHT
1. That
special leave to appeal is granted.
2. That
the appeal is allowed.
3. That
the decision of the master on 8 August 2014 is set aside.
4. The
High Court of Australia lawfully directs the masters to accept the documents
for filing in the Adelaide Registry of the Supreme Court of South Australia and
set down a date for hearing within 28 days, and furthermore that the appellant
serve summons and all other legal documents upon the Supreme Court of South
Australia and the respondent within 7 days.
5. A
declaration by the High Court of Australia that this matter is not an abuse of
process.
